The changes set forth in HB 791 will make it easier for the townhomes and condos to govern more effectively and in particular, they will make it easier to impose fines and on line voting will be allowed.
Fines - The current townhome and condo fine processes requires that a hearing be held by the Fines Committee to set the fine. This is a real pain because the hearing date has to be set and scheduled and people on the Fines Committee scheduled to attend, before the Notice of Fine can be sent to the alleged violator. And the alleged violator does not even have to RSVP - all he/she has to do is show up at the hearing - or not - when the Fines Committee meets to set the amount of the fine.
HB 791 streamlines the process by allowing the board to set the fine up front and then notify the alleged violator that they are being fined and that they have the opportunity for a hearing only if they request a one in writing. Thus a hearing will only be required when requested in writing.
On Line Voting - HB 791 makes it clear that on line voting is permissible - as long as certain detailed requirements are met. And you know what, the requirements are reasonable and the townhomes and condos can meet them and allow online voting for our annual meeting this year - in parallel with in person and paper voting for those that want to stick the existing options - with no more than a board resolution required for approval.
