Fines - Violation Letters

Violations are here considered to be of two types, occurrence related violations, as in not picking up after one’s dog and ongoing violations, as in not removing a nonworking vehicle from the property.

The fine for an occurrence related violation is $25.00 per violation. The fine for an ongoing violation is $25.00 per day. In either case the total amount of the fines is limited to $1000.00.

In the case of occurrence related violations, the count will be reset to zero after six months have passed since the last violation.

FIRST NOTICE

A FIRST NOTICE of the violation shall be mailed via regular mail to the unit owner with a copy to the tenant, if any, requesting immediate compliance for an occurrence related violation and compliance within seven (7) days for an ongoing violation.

Subject: Violation of Rules and Regulations – FIRST NOTICE

On 6/21/2010 it was observed that someone in your household was smoking in the condominium hallway.

Smoking in the condominium hallways, breezeways, and stairwells is not allowed per the association rules and regulations.

Please discontinue smoking in the condominium hallways.

Thank you for your cooperation in making Green Cay Village a great place to live for all residents.

Sample FIRST NOTICE Violation Letter
Ongoing Violation

Subject: Violation of Rules and Regulations – FIRST NOTICE

On 6/21/2010 it was observed that you are parking a commercial vehicle in the condominium parking lot.

Parking of commercial vehicles in the condominium parking lot is not allowed per the association rules and regulations.

Please make arrangements within the next seven (7) days (by 6/28/2010) to park your vehicle elsewhere.

Thank you for your cooperation in making Green Cay Village a great place to live for all residents.

FINAL NOTICE

If the violation occurs again in an occurrence related violation or continues in an ongoing violation, a FINAL NOTICE shall be mailed via regular mail to the unit owner with a copy to the tenant, if any, requesting immediate compliance for an occurrence related violation and compliance within even (7) days for an ongoing violation and in either case noting that if this violation occurs again/continues a fine will be imposed.

On 7/1/2010 it was observed that someone in your household was smoking in the condominium hallway.

Smoking in the condominium hallways, breezeways, and stairwells is not allowed per the association rules and regulations.

Please be advised that if this violation occurs again, you will be fined per the powers granted by the Florida Statutes and the association documents for each additional violation.

Ongoing Violation

Subject: Violation of Rules and Regulations – FINAL NOTICE

On 7/1/2010 it was observed that you are still parking a commercial vehicle in the condominium parking lot.

Parking of commercial vehicles in the condominium parking lot is not allowed per the association rules and regulations.

Please be advised that if this violation is not satisfactorily addressed within the next seven (7) days (by 7/8/2010), you will be fined per the powers granted by the Florida Statutes and the association documents for each day that this violation continues beyond 7/8/2010.

NOTICE OF FINE

If the violation occurs again in an occurrence related violation or continues in an ongoing violation, a NOTICE OF FINE shall be mailed via certified mail, return receipt requested, to the unit owner with a copy to the tenant, if any, noting that a fine is being levied in the amount of $25.00 for an occurrence related violation or $25.00 per day for an ongoing violation and that the unit owner or tenant has the right to contest the fine by delivering written notice to the association within fourteen (14) days after receipt of the notice imposing the fine.

Note: NOTICE OF FINE letters need to be signed by an officer of the association.

Please be advised that a fine of $25.00 is being levied against your account per the powers granted by the Florida Statutes and the association documents and that you have the right to contest this fine by delivering written notice to the association within fourteen (14) days of receipt of this notice.

Subject: Violation of Rules and Regulations – NOTICE OF FINE

On 7/9/2010 it was observed that you are still parking a commercial vehicle in the condominium parking lot.

Parking of commercial vehicles in the condominium parking lot is not allowed per the association rules and regulations.

Please be advised that a fine of $25.00 is being levied against your account for each day that this violation continues beyond 7/9/2010 per the powers granted by the Florida Statutes and the association documents and that you have the right to contest this fine by delivering written notice to the association within fourteen (14) days of receipt of this notice.
